Classified Cosmetics alleges Del Laboratories infringed patent

Classified Cosmetics has filed a motion for a preliminary
injunction against cosmetics and over-the-counter pharmaceuticals
manufacturer Del Laboratories in a suit that alleges patent
infringement.

Classified Cosmetics​is insisting that New York-based Del Laboratories​ cease and desist the further manufacture and sale of its 'Sally Hansen Fast and Flawless Airbrush Makeup' and 'Airbrush Legs' products.

"Based on the favorable rulings of the Federal Court thus far and the clear cut facts, it's time to get this case to judgment,"​ said Gary Hecker, managing partner of Los Angeles-based patent, trademark and copyright firm The Hecker Law Group​, attorneys for plaintiff Classified Cosmetics.

Los Angeles-based Classified Cosmetics is alleging that Del Laboratories clearly infringes its United States Patent No. 6,589,541 and will be seeking an injunction at a hearing scheduled for 19 July 19 2004 in California.

In a recent CosmeticsDesign.comarticle​, we reported that the maker of Arm & Hammer toothpastes Church & Dwight​ and private investment firm Kelso have agreed to acquire cosmetics and over-the-counter drugs manufacturer Del Laboratories.

Del Laboratories is to be acquired by Church & Dwight and Kelso for a purchase price of US$385 million (€313 m), plus the assumption of debts amounting to US$80 million (€65 m) through investment vehicle DLI Holding.
